<p>การที่ชายและหญิงอยู่กินกันฉันสามีภริยากัน โดยมิได้จดทะเบียนสมรส บุตรที่เกิดมากฎหมายถือว่า เป็นบุตรที่ชอบด้วยกฎหมายของมารดา (ประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 1546) เด็กที่เกิดจากบิดามารดาที่มิได้จดทะเบียนสมรสกันจะเป็นบุตรที่ชอบด้วยกฎหมายของบิดาต่อเมื่อดำเนินการตามเงื่อนไขอย่างใดอย่างหนึ่งดังต่อไปนี้:</p> </div> </div> <div class="panel panel-primary"> <div class="panel-heading"> <h2 class="panel-title">วิธีการทำให้บุตรเป็นบุตรที่ชอบด้วยกฎหมายของบิดา</h2> </div> <div class="panel-body"> <ol class="custom-list"> <li> <h3>บิดามารดาสมรสกันในภายหลัง</h3> <p>คือ บิดามารดาไปจดทะเบียนสมรสกันที่สำนักทะเบียนอำเภอ/สำนักงานเขต บุตรก็จะเป็นบุตรที่ชอบด้วยกฎหมายของบิดาตั้งแต่วันที่บุตรเกิด</p> </li> <li> <h3>บิดาได้จดทะเบียนว่าเป็นบุตร (กรณีบิดาสมัครใจ)</h3> <p>มารดาและบุตร (อายุเกิน 8 ปีบริบูรณ์) สามารถให้ความยินยอมได้ ดำเนินการดังนี้:</p> <h4>ขั้นตอนการดำเนินการ ณ สำนักทะเบียนอำเภอ/สำนักงานเขต:</h4> <ul class="list-group"> <li class="list-group-item">บิดา มารดา และบุตร ต้องไปดำเนินการ ณ สำนักทะเบียนอำเภอ/สำนักงานเขต</li> <li class="list-group-item">นำพยาน 2 คน อายุ 20 ปีบริบูรณ์ขึ้นไป พร้อมบัตรประจำตัวประชาชน</li> <li class="list-group-item">บิดาต้องยื่นคำร้อง (แบบ คร.1) ณ สำนักทะเบียนอำเภอ/สำนักงานเขต</li> <li class="list-group-item">เมื่อนายทะเบียนอนุญาตให้จดทะเบียนได้ นายทะเบียนจะให้บิดา มารดา บุตร และพยานลงลายมือชื่อและมอบทะเบียนรับรองบุตร (คร.11) ให้ไว้เป็นหลักฐาน</li> </ul> </li> <li> <h3>ศาลพิพากษาว่าเป็นบุตร</h3> <p>การยื่นคำร้องขอรับรองบุตร (บิดาสมัครใจ) ต่อศาล ทำได้ในกรณีดังต่อไปนี้:</p> <ul class="list-group"> <li class="list-group-item">บุตรไม่สามารถให้ความยินยอมได้ (เช่น อายุยังน้อย หรือมีเหตุอื่น)</li> <li class="list-group-item"><span class="emphasize">มารดาหรือบุตรไม่ยินยอม</span></li> <li class="list-group-item">มารดาเสียชีวิต ไม่สามารถให้ความยินยอมได้</li> </ul> </li> </ol> </div> </div> <div class="panel panel-primary"> <div class="panel-heading"> <h2 class="panel-title">เอกสารที่ใช้ประกอบคำร้องขอรับรองบุตร (ต่อศาล)</h2> </div> <div class="panel-body"> <p>สำหรับการยื่นคำร้องต่อศาลในกรณีที่บิดาสมัครใจ แต่ไม่สามารถจดทะเบียนที่อำเภอ/เขตได้ด้วยเหตุผลข้างต้น:</p> <ol class="list-group"> <li class="list-group-item">บัตรประจำตัวประชาชนของผู้ร้อง (บิดา), มารดา และบุตร</li> <li class="list-group-item">ทะเบียนบ้านของผู้ร้อง, มารดา และบุตร</li> <li class="list-group-item">สูติบัตรของบุตร</li> <li class="list-group-item">หนังสือให้ความยินยอมของมารดา (กรณีมารดายังมีชีวิตและยินยอม)</li> <li class="list-group-item">คำร้องขอจดทะเบียนและบันทึกทะเบียนครอบครัว (แบบ คร.1) (ถ้ามี หรือใช้เป็นส่วนหนึ่งของคำร้องต่อศาล)</li> <li class="list-group-item">มรณบัตรของมารดา (กรณีมารดาเสียชีวิต)</li> <li class="list-group-item">ใบเปลี่ยนชื่อ - สกุลของบิดา มารดา บุตร (ถ้ามี)</li> <li class="list-group-item">หลักฐานการตรวจทางพันธุกรรม (DNA) (ถ้าจำเป็น) <ul> <li>ถ่ายเอกสารรวม 2 ชุด ส่งให้สถานพินิจฯ 1 ชุด ผู้ร้องเก็บไว้ 1 ชุด</li> <li>กรณียื่นเอกสารที่ศาล ต้องถ่ายเอกสารรวม 3 ชุด</li> </ul> </li> </ol> </div> </div> <div class="panel panel-primary"> <div class="panel-heading"> <h2 class="panel-title">ขั้นตอนการดำเนินการยื่นคำร้องต่อศาล (กรณีบิดาสมัครใจ)</h2> </div> <div class="panel-body"> <ol class="custom-list"> <li> <h4>เขียนคำร้อง ทำได้ 2 วิธี คือ:</h4> <ul> <li>ขอให้เจ้าหน้าที่ศาลงานบริการประชาชนฯ ช่วยแนะนำในการเขียนหรือขอให้เจ้าหน้าที่เขียนให้</li> <li>เขียนคำร้องด้วยตนเอง โดยขอแบบพิมพ์ได้ที่ งานบริการประชาชนฯ หรือดาวน์โหลดแบบฟอร์มได้ที่ เว็บไซต์ของศาลยุติธรรม (www.coj.go.th) เลือกแบบที่ 7 คำร้อง และ แบบที่ 15 บัญชีพยาน จะเขียนด้วยลายมือหรือจะพิมพ์ก็ได้</li> </ul> </li> <li> <h4>จัดเตรียมเอกสาร</h4> <ol> <li>ต้นฉบับคำร้อง พร้อมเอกสารท้ายคำร้อง (นำมาจากเอกสารที่ใช้ประกอบคำร้อง 1-8 ข้างต้น) โดยใส่ตัวเลขกำกับที่ด้านบนของเอกสารด้วย</li> <li>ต้นฉบับบัญชีพยาน</li> <li>คำแถลงขอวางเงินค่านำส่งคำคู่ความ (ทำสำเนาเอกสารตามข้อ 1 และข้อ 2 สำหรับส่งให้สถานพินิจ 1 ชุด ผู้ร้องเก็บไว้เอง 1 ชุด)</li> </ol> </li> <li> <h4>สถานที่ยื่นคำร้อง</h4> <p>คือ ศาลเยาวชนและครอบครัวที่มีอำนาจในเขตพื้นที่ ดังนี้:</p> <ul> <li>พื้นที่ที่ผู้ร้อง (บิดา) มีภูมิลำเนาอยู่ (มีชื่อในทะเบียนบ้าน)</li> <li>หรืออาจยื่นที่ศาลเยาวชนและครอบครัวที่บุตรมีชื่อในทะเบียนบ้าน</li> <li>หรือท้องที่ที่บิดามารดาได้อยู่กินฉันสามีภริยา ซึ่งถือว่าเป็นสถานที่มูลคดีเกิด</li> <li>กรณีเป็นคำฟ้องให้ยื่นศาลเยาวชนและครอบครัวที่จำเลยมีภูมิลำเนาอยู่</li> </ul> </li> <li> <h4>ค่าใช้จ่ายในการยื่นคำร้อง</h4> <ul class="list-group"> <li class="list-group-item">ค่าขึ้นศาล จำนวน 200 บาท (ต่อบุตร 1 คน)</li> <li class="list-group-item">ค่าประกาศหนังสือพิมพ์จำนวน 500 บาท (ปัจจุบัน <span class="label label-info">ไม่ต้องชำระ</span>)</li> <li class="list-group-item">ค่าส่งคำคู่ความ (ถ้ามี)</li> </ul> </li> <li> <h4>การยื่นคำร้อง</h4> <p>ให้ยื่นที่งานรับฟ้องคดีแพ่ง/คดีครอบครัว เจ้าหน้าที่จะกำหนดวันนัดไต่สวนคำร้อง ส่วนใหญ่จะกำหนดไม่น้อยกว่า 45 วันนับแต่วันยื่นคำร้องขอ</p> </li> <li> <h4>ให้ถ้อยคำที่สถานพินิจฯ</h4> <p>ผู้ร้อง (บิดา) จะต้องนำมารดา บุตร และหรือผู้เกี่ยวข้องรู้เห็นไปให้ถ้อยคำที่สถานพินิจฯ ตามกำหนดนัด ส่วนใหญ่จะภายใน 15 วันนับแต่วันที่ศาลมีคำสั่งรับคำร้อง</p> </li> <li> <h4>ไต่สวนคำร้อง</h4> <p>กรณีไม่มีผู้คัดค้าน ผู้ร้องจะต้องนำพยานที่อ้างไว้ในบัญชีพยานมาสืบหรือให้ถ้อยคำต่อศาล โดยนำต้นฉบับเอกสารแนบท้ายคำร้องมาให้ศาลตรวจสอบด้วย ศาลจะพิจารณาคำเบิกความพยาน ประกอบกับรายงานของสถานพินิจฯ แล้วถึงจะมีคำสั่ง</p> </li> <li> <h4>การจดทะเบียนรับรองบุตร (หลังศาลมีคำสั่ง)</h4> <p>เมื่อครบกำหนดระยะเวลา 1 เดือนนับแต่วันพิพากษาหรือคำสั่ง ผู้ร้องจะต้องมาขอคัดถ่ายคำพิพากษาหรือคำสั่ง โดยให้เจ้าหน้าที่ศาลรับรองสำเนาถูกต้อง และขอใบสำคัญคดีถึงที่สุด (ชำระค่ารับรองคำสั่งและหนังสือรับรองคดีถึงที่สุดฉบับละ 50 บาท และค่าถ่ายเอกสารตามจริง) แล้วจึงนำไปจดทะเบียนที่สำนักทะเบียนอำเภอ/สำนักงานเขต</p> </li> </ol> </div> </div> <div class="panel panel-primary"> <div class="panel-heading"> <h2 class="panel-title">การรับรองบุตรกรณีบิดาไม่สมัครใจ</h2> </div> <div class="panel-body"> <div class="well"> <p>หากบิดามารดาไม่ได้จดทะเบียนสมรสและบิดา <span class="emphasize">ไม่ยอมรับบุตร</span> จะต้องทำเป็นคำฟ้องขอให้รับเด็กเป็นบุตร ส่วนใหญ่จะฟ้องเรียกค่าอุปการะเลี้ยงดูด้วย</p> <ul class="custom-list"> <li>ถ้าบุตรอายุไม่ถึง 15 ปี มารดาหรือผู้แทนโดยชอบธรรมฟ้องแทน</li> <li>ถ้ามารดาเสียชีวิตและไม่มีผู้แทนโดยชอบธรรม ต้องให้อัยการฟ้องแทน</li> <li>ถ้าบุตรอายุ 15 ปีบริบูรณ์ บุตรฟ้องเองได้โดยไม่ต้องได้รับความยินยอมจากผู้แทนโดยชอบธรรม</li> <li>กรณีบุตรบรรลุนิติภาวะ (อายุ 20 ปีบริบูรณ์) จะต้องฟ้องขอให้รับรองบุตร <span class="emphasize">ภายใน 1 ปี</span> นับแต่วันที่บรรลุนิติภาวะ</li> </ul> </div> </div> </div> <div class="panel panel-primary"> <div class="panel-heading"> <h2 class="panel-title">กรณีบิดาเสียชีวิตก่อนที่จดทะเบียนรับรองบุตร</h2> </div> <div class="panel-body"> <div class="well"> <p>จะต้องทำเป็นคำร้องขอให้ศาลมีคำสั่งว่าเป็นบุตร แต่ควรร้อง <span class="emphasize">ภายใน 1 ปี</span> นับแต่วันที่บิดาเสียชีวิต เพราะอายุความฟ้องร้องเรียกมรดกมีกำหนด 1 ปี</p> </div> </div> </div> <div class="note-section"> <h4>หมายเหตุ</h4> <p>ศาลเยาวชนและครอบครัวจัดทำคำร้องรับรองบุตรให้เฉพาะกรณีบิดาสมัครใจหรือมารดาเสียชีวิต นอกจาก 2 กรณีนี้ให้ไปขอความช่วยเหลือจากอัยการคุ้มครองสิทธิ์ หรือสำนักงานยุติธรรมจังหวัด หรือใช้บริการทนายความตามสำนักงานทนายความทั่วประเทศ</p> </div> </div> <p>&nbsp;<img alt=""
